Terms and Conditions for Portrait Photography

 

NOTE: Gary and Sue Photography is the trading name of Gary and Sue Photography Ltd.

 

1) SESSION FEES & RESERVATION FEES
The Session Fee covers the photographer’s time and talent only, does not include any images (unless stated in any session or promotion offer information) and is due at time of booking. Session fees taken for any portrait photography session are non-refundable except in the event that Gary and Sue Photography cancel the booking.

A Refundable Reservation Fee is payable when Gary and Sue Photography offer a session as part of a Promotion/Competition/Model Callout.  This Reservation Fee is totally refundable at the Viewing Session providing that all the agreed clients turn up at the agreed Portrait Session and Viewing Session times.  In the event that either appointment needs changing, a further Reservation Fee will be charged and this will only be deducted from any products or services purchased.

In the event that a new Portrait Session or Viewing Session is required, Gary and Sue Photography reserve the right to charge a further £20 Reservation Fee, which may be deducted from any order made at the discretion of Gary and Sue Photography.

2) SICKNESS
Gary and Sue Photography understand that children can be unpredictable and fall ill at any time. In the event of sickness prior to the session, the Client agrees to make every possible effort to inform Gary and Sue Photography no later than 72 hours prior to the start time of the photography session. The session can be transferred to a new date which will be at the convenience of both parties within a maximum 4 week period. Gary and Sue Photography reserve the right to re-schedule outside of this time limit due to any existing commitments. If the Client fails to reschedule within the 4 week time period, Gary and Sue Photography has the right to cancel the booking with the Session Fee/Reservation Fee payment made non-refundable. If a client is a no show, a further Reservation Fee will be charged.

3) PHOTOGRAPHY SESSION
Gary and Sue Photography shall be entitled to use their judgement regarding the style and flow of the session. This includes but is not limited to poses, props and number of images taken. Due to the willingness of subjects it may not be possible to capture all the pictures requested, or images to the client’s full expectations. In the event of uncooperative children at a session of any kind, for any reason, Gary and Sue Photography may not be able to capture any, or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions.

4) PRICE OF PRODUCTS
Session fees do not include any images or products (unless stated in the information or offer details).  As a guide clients generally spend from £195, with desktop framed images from £65, following any session.  An up to date Product Guide will be made available at the Portrait Session together with any Current Special Offers.

5) FULFILLMENT OF OBLIGATIONS
Gary and Sue Photography shall not be liable to the Client for any failure, in whole or in part, to fulfil their obligations where failure arises as a result of an event or circumstances beyond their control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. The Client understands and accepts that the photographic coverage will be as Gary and Sue Photography’s professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes. In the unlikely event of total photographic failure or cancellation of the contract by Gary and Sue Photography liability shall be limited to a full refund of all monies paid.

6) ARTISTIC INPUT ~ IMAGES
Gary and Sue Photography shall be entitled to use their judgement regarding the style and artistic input in the production of pictures. The editing process is a large part of the finished image and reflects the artistic style of Gary and Sue Photography. Images are adjusted for tonality, colour and style before presenting to Client at the viewing session. Additional edits are carried out at the discretion of Gary and Sue Photography, and Gary and Sue Photography reserve the right to charge the Client for additional editing to cover time involved. Camera Raw files are not available for purchase by the client.

7) VIEWING AND ORDER SESSION
There is no guarantee that any particular number of preview images will be produced. Previews will be available at the Viewing Session normally within 2 weeks.  All orders taken at the First Viewing Session will be at a discounted rate.  Orders placed after the first viewing will be at the Full Price. For all orders, payment is due in full at time of order or a payment plan agreed. Artwork production will only start once the payment has been received in full.  All portrait orders are final and cannot be changed or refunded for any reason.

8) COPYRIGHT & REPRODUCTION
Copyright is retained by Gary and Sue Photography at all times throughout the world. No image can be copied, scanned or reproduced in any form whatsoever without the prior consent of Gary and Sue Photography. The Client may not alter or add to or manipulate a picture by any means or reproduce a picture in whole or in part as an element within, or as a montage with, another picture without Gary and Sue Photography’s written permission. Permission to reproduce a picture for personal use (not commercial) is granted to the Client by Gary and Sue Photography only when digital images are purchased and paid in full by the Client to Gary and Sue Photography.

9) USE OF PICTURES
If you have given Gary and Sue Photography permission to do so, we may use one or more photographs on our website, social media or in our marketing media.

10) RECEIPT OF PORTRAITS, WALL ART OR PRODUCTS
All orders are presumed to have been received in good condition unless the Client notifies Gary and Sue Photography on collection and in writing of any discrepancy or error within 14 days of receipt.

11) COOLING OFF PERIOD
All portraits, books, albums, frames, digital images etc. are non-returnable.  Once paid for, orders cannot be cancelled due to the custom nature of the products. Orders are made to the Client’s personal specification, (i.e. image number, print size, frame style, etc.), the Client does not have the right to a cooling off period. By placing an order with Gary and Sue Photography you are committing to buy the ordered products.

12) RETURNS POLICY
Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client. Returns will not be considered for items ordered incorrectly or items ordered in error.

13) DELETED IMAGES
All non-purchased Hi Res jpg images may be deleted 4 weeks after your Viewing Session or 3 months after the Photography Session, whichever is sooner.

14) CLIENTS OWN CAMERAS AND RECORDING DEVICES
Cameras, mobile phone cameras and camcorders are NOT permitted during any session, in studio or on location.

 

The Xperience Group Baby of the Month Competition Terms and Conditions

The winners of the Xperience Group’s Baby of the Month Competitions are decided purely by the highest number of Likes or Loves on our monthly competition albums on our Facebook page.
There will be one winner announced each calendar month.

How to vote:
ENTRY OPEN FROM TUESDAY 2nd April 2019 To vote, you need to ‘Like‘ or ‘Love‘ the image of your choice in the relevant Baby of the month competition album found on our Xperience Group Facebook page. The Winning baby image will have the most combined ‘Likes’ and ‘Loves’.
Alternative ‘reactions’ (‘Haha‘, ‘Wow‘, ‘Sad‘ and ‘Angry‘) will not count as a vote. You can only vote for an image once: Facebook will only allow individual accounts to ‘like’ or ‘love’ once per image.

‘Likes‘ or ‘Loves‘ will only be counted on the images that are in the competition album on the Xperience group’s Facebook page. ‘Likes‘ or ‘Loves‘ on images shared outside of the album will not be counted.

In the event of a tie, the winning image will be decided by an independent judge chosen by The Xperience Group.

Participation in the competition:
All babies entered in to the competition, must be aged from 0-12 months.
Choose one image from your baby portrait session to enter in to The Xperience Group’s Baby of the Month Competition, via your participating Xperience photographer.
It will be up to your Xperience Photographer and the Xperience Group to submit and upload your chosen image to the Baby of the Month Facebook album for the public vote.
Parents/Guardians who choose to participate in the competition accept that their baby’s image can be viewed, voted for and commented on by the public on Facebook.
Prior consent has been given from Parents/Guardians of the baby(s) featured in each monthly competition. All images submitted into Baby of the Month have been professionally photographed by a current member of the Xperience Group, that have actively agreed to participate in this competition.
The winning entry from each month: Parents/Guardians have given their consent for the images to be used in any relevant media content created by the Xperience Group. This includes marketing, packaging, advertising, website and social media. This can also include raising awareness on social media for this competition.
The Xperience Baby of the Month Competition is not associated with any other competition. The promotion of other competitions on the Baby of the Month Facebook page is prohibited.

Competition prizes and notification
There will be one winner throughout the Xperience Group announced each calendar month.
The monthly prize for the winning image is £200 John Lewis Vouchers. No cash alternative to the prize will be offered.
The monthly winner will be contacted by their Xperience Photographer, on behalf of The Xperience Group, within 14 days of the competition closing date.
In the event of circumstances arising outside of our control, The Xperience Group of Photographers reserve the right, to cancel or change the competition at any stage.
The decisions of The Xperience Group are final, and no correspondence will be entered in to.
The competition is not open to employees or contractors of The Xperience Group.
The Xperience group’s Baby of the Month photography competition is administered by The Xperience Group.
